1 - Access and Use
Access to the CaskBlock website products and services is subject to the following conditions. Using the CaskBlock website you agree to the Terms of Use which may be updated sporadically. For your benefit and ours please regularly visit the Terms and Conditions page to check for any changes. Access to the CaskBlock website is temporary and we reserve the right to withdraw add or change products and services without prior notice. Occasionally the CaskBlock website may be unavailable for updates or other reasons and we may restrict access to certain areas of the website. CaskBlock cannot be held responsible for damages or losses incurred by any individual or entity resulting from the use of any information contained on this website. Links available on the CaskBlock website may lead to external sites. By clicking on these hyperlinks you will leave the CaskBlock website and CaskBlock has no control over activities on these external sites and cannot take responsibility for anything that occurs outside our platform.2 – Purchasing and selling CaskBlock NFTs on our platform
To make purchases through the CaskBlock website buyers must be of legal age (+ 18 or +21 years old depending on their jurisdiction) and provide accurate information to allow the successful processing of their orders.Availability and Pricing:We periodically make CaskBlock NFTs available for purchase on our Platform. The price for each CaskBlock NFT is denominated in Near and USDC and determined by us or through an auction process. Availability is not guaranteed and we reserve the right to modify the types prices and quantities of CaskBlock NFTs at our discretion.
Risk of Off-Platform Transactions:If you decide to buy or sell a CaskBlock NFT outside our Platform you do so at your own risk.
KYC and AML Checks:We conduct “Know Your Client” and anti-money laundering checks using third-party providers. Failure to pass these checks may restrict certain transactions on our Platform.
Secondary Marketplaces:CaskBlock NFTs can be traded on smart contract-enabled secondary marketplaces. Compatibility with all Secondary Marketplaces is not guaranteed. We are not a party to transactions on Secondary Marketplaces even if the NFT was initially purchased via our Service. We are not liable for losses related to Secondary Marketplace transactions.
Third-Party Sites:Our Terms apply only to our Services not to Third-Party Sites. Links to Third-Party Sites are provided for convenience but we do not endorse or control them. Use Third-Party Sites at your discretion; we are not responsible for their content or accuracy.
3 - Prices and Payment Options
CaskBlock accepts the following payment methods: My Near Wallet Mintbase Wallet and Meteor Wallet.Payment Options:You can purchase CaskBlock NFTs using cryptocurrency. You’ll need a digital wallet to accept your CaskBlock NFT. We do not hold custody or ownership of your CaskBlock NFT except as described in these Terms.
Cryptocurrency Purchases:If you buy a CaskBlock NFT using your digital wallet and cryptocurrency it will be minted directly into that wallet. Ensure your wallet has sufficient Near / USDC to cover the purchase and any associated gas fees.
Third-Party Sites:Our Terms apply only to our Services not to Third-Party Sites. Links to Third-Party Sites are provided for convenience but we do not endorse or control them. Use Third-Party Sites at your discretion; we are not responsible for their content or accuracy.
4 - Product Information
At CaskBlock we strive to ensure that all details descriptions and prices of the products presented are correct. However if product information including prices or promotions is incorrectly published CaskBlock may refuse an order based on these criteria. An order can be rejected due to the following issues: product out of stock inability to obtain payment authorization or fraudulent orders. If there is a problem with your order you will be contacted immediately by CaskBlock. Orders that have not yet been dispatched can be canceled by contacting us. CaskBlock may change prices without prior notice.5 - Redeeming your CaskBlock NFT
Redemption Process:When you purchase a CaskBlock NFT the associated Product remains in our or our partner’s possession until you redeem it. The “Redemption Start Date” is stated on the Token Warrant at NFT Product Detail on our website indicating when you can begin the redemption process. A “Redemption End Date” may also be provided but it is subject to change. You are responsible for checking updates on these dates. After the Redemption End Date we reserve the right to either burn the CaskBlock NFT or render it non-redeemable (e.g. by altering artwork or metadata). We may also mint a new NFT associated with the Product.Redemption Requirements:To redeem your CaskBlock NFT you must burn your NFT on our Website. Provide the necessary information (name address email) for shipping the Product. Note that we cannot ship to certain jurisdictions or minors not legally allowed to accept delivery.
Finality of Redemption Requests:All redemption requests are final and cannot be reversed.
Compliance and Shipping:Comply with importation and customs laws when redeeming a CaskBlock NFT. Represent that the alcohol is for personal consumption and that the delivery jurisdiction permits alcohol sales. Refer to the “Shipping of our Products” section for additional terms related to product shipment.
6 - Revoking your CaskBlock NFT
A - CaskBlock NFT Revocation and Alcohol-Related PoliciesRevocation Authority:CaskBlock maintains the right to revoke your CaskBlock NFT under the following circumstances: Violation of the Terms of Use including intellectual property license terms. Loss of access to the digital wallet containing the NFT. Withdrawal of CaskBlock's rights to offer the NFT.
Revocation Consequences:Violation-based revocation may result in forfeiture of amounts paid for the NFT. In cases of lost wallet access CaskBlock may offer assistance but cannot guarantee recovery. Revoked NFTs may become inaccessible in your digital wallet impacting redemption and associated features.
B - Alcohol-Related Policies
Age Verification:CaskBlock prohibits intentional alcohol sales to minors. NFT purchase constitutes an affirmation of legal drinking age compliance. Responsibility for age verification extends to gift recipients.
Resale Restrictions:Reselling alcohol without proper licensing is strictly prohibited
Shipping and Regulatory Compliance:Users must represent compliance with local laws and regulations. Confirmation of legal entitlement to receive and possess ordered quantities of alcoholic beverages is required. CaskBlock's shipping arrangements presume adherence to all applicable legal requirements. By engaging with CaskBlock NFTs and associated products you acknowledge and agree to abide by these policies. Failure to comply may result in revocation of NFTs denial of redemption or other legal consequences.
7 - Intellectual Property
Definition of Content "Content" encompasses all elements on our Platform and within CaskBlock and Artwork NFTs including but not limited to: Textual elements. Graphics and logos. Icons and images. Artwork. Audio and video clips. Software components (this definition extends to legally protectable elements derivatives translations adaptations and variations thereof).Ownership of Intellectual Property:We retain or license all intellectual property rights in the Content. Trademarks copyrights service marks and trade names within the Content may be the property of: Our company. Our licensors. Our partners.
Limited License Grant:We grant you a non-exclusive non-sublicensable license to: Use the Content for personal non-commercial purposes. Display copy and use Content on our Platform or Secondary Marketplaces solely for NFT sales. Maintain all copyright and proprietary notices intact.
Usage Restrictions:Unauthorized use of Content is strictly prohibited. You must not confuse or disparage our company or our licensors. Commercial exploitation reproduction distribution or modification of Content requires our explicit written consent. Content usage is restricted to authorized transactions on our Platform.
NFT Ownership and Associated Artwork:Purchase of a CaskBlock NFT confers full ownership rights including storage sale and transfer. Artwork associated with the NFT is licensed solely as described in Section 3. NFT ownership does not represent actual ownership of the Product until redeemed.
Feedback Provision:You may submit feedback via the designated email address. By submitting feedback you grant us a perpetual nonexclusive license to use and incorporate your suggestions. By engaging with our Platform and Content you agree to abide by these terms. Any violation may result in termination of your access and potential legal action.
8 - Intellectual Property and Trademarks
Subject to any contrary provisions in these Terms the Service and Content may incorporate software components provided by CaskBlock its affiliates or third parties. These software components are governed by separate license terms.The following intellectual property elements are associated with CaskBlock:
Trademarks:The CaskBlock logo product names service names logos and slogans displayed on the Service are trademarks owned by CaskBlock or its affiliates. Unauthorized copying imitation or use of these trademarks in whole or part without our prior written permission is strictly prohibited.
Trade Dress:The overall look and feel of the Service and Content including page headers custom graphics button icons and scripts constitute the service mark trademark or trade dress of CaskBlock.
Other Trademarks:Any other trademarks registered trademarks product names or CaskBlock-related names or logos mentioned on the Service are the property of their respective owners. These trademarks may not be copied imitated or used without the permission of the relevant trademark holder. Reference to specific products services processes or other information by name trademark manufacturer supplier or otherwise does not imply endorsement sponsorship or recommendation by CaskBlock.
9 - Acknowledgments and Assumption of Risk
Age Requirement and Legal Compliance:Users must be of legal drinking age to redeem physical items. Strict enforcement of beverage alcohol laws; violations will be reported.User Responsibilities:Users are accountable for their conduct on the Platform. Usage must comply with these Terms and all applicable laws. Users warranting their use won't violate laws agreements or others' rights.
Prohibited Actions:No intentional law violations. No underage alcohol distribution. No identity misrepresentation. No unauthorized access or tampering. No framing or linking without permission. No automated scraping. No harmful or offensive content.
CaskBlock NFT Risks:
Access and Security:Potential loss of passwords or wallet access. Transaction errors due to mistyped addresses.
Technical Risks:Smart contract errors. Platform malfunctions. Blockchain issues and cybersecurity threats.
Market and Regulatory Risks:Missed opportunities for redemption or resale. Uncertain legal status of NFTs. Potential regulatory changes affecting NFT utility.
Platform Changes:Possible modifications to NFT accessibility. Potential blockchain forks.
Intellectual Property:Possible creation of additional Brand Art copies. Potential reassignment of copyright.
NFT Terms and Conditions:
Valuation:Subjective pricing of CaskBlock NFTs and Products. Value dependent on public interest.
Purpose:NFTs are intended for consumption not investment. Value limited to redemption (for CaskBlock NFTs).
Ownership Limitations:No equity or ownership rights are conferred. Potential resale restrictions.
Security Risks:Potential loss or compromise of cryptocurrencies. Risk of counterfeit NFTs or content misuse.
Market Volatility:High volatility in NFT markets. Potential for rapid value decrease.
Business Risks:Company operational challenges may impact NFT value. Possibility of business cessation affecting NFTs. By using our Platform and engaging with CaskBlock NFTs you acknowledge and accept these terms and risks. We advise careful consideration before participation.
10 - Redemption Responsibility
Once we accept your offer to redeem a Product our responsibility ends (except for shipping obligations). Ownership records for CaskBlock NFTs exist on the Near Protocol Blockchain.11 – Disclaimer of Warranties
Service Disclaimer:We provide our Services Platform CaskBlock NFTs products and content on an "as is" and "as available" basis without express implied or statutory warranties. This includes but is not limited to:Accuracy and Reliability:We make no guarantees regarding the accuracy security or reliability of our functions features operations content or other information. Your use of our Services is at your own risk.
Service Continuity:We do not warrant the uninterrupted or error-free operation of our Services or Platform. We do not guarantee prompt correction of defects or malfunctions nor do we assure that our site is free from viruses or harmful elements.
Fitness for Purpose:We make no representations about the suitability reliability availability or timeliness of our offerings. We disclaim all warranties of merchantability title non-infringement of third-party rights and fitness for any particular purpose.
Platform Status:CaskBlock operates as an administrative platform. We are not a broker financial institution or creditor. While we facilitate transactions between buyers and sellers in auctions/sales we are not a party to any agreements between users regarding crypto assets.
Force Majeure:Neither party shall be held responsible for failing to meet obligations under these Terms due to circumstances beyond reasonable control. Such circumstances include but are not limited to: Natural disasters (fire flood etc.). Armed conflicts or terrorist attacks. Labor disputes. Pandemics. Technology or telecommunications failures. Cyberattacks. Unauthorized third-party activities.
Liability Limitations:We shall not be liable for errors or failures related to executing purchases of your CaskBlock NFT except in cases of gross negligence. This limitation extends to errors caused by: Failure to follow instructions. Loss of connection. Software or device failures. Other omissions. By using our Services you acknowledge and accept these disclaimers and limitations. We recommend you carefully consider these terms before engaging with our platform.
12 - Limitation of Liability
We are not liable for any indirect punitive incidental special or consequential damages to you or others. This includes but is not limited to: Loss of use data or profits. Damages related to our website this agreement platform use or performance inability to use our platform or service provision/failure. Damages from events information software products services and graphics obtained through our platform. These limitations apply regardless of the legal theory (contract tort negligence strict liability etc.) even if warned of potential damages. Our total liability under any legal theory is capped at the initial sale amount of the CaskBlock NFT on our or another platform that is the subject of the claim. These limitations do not apply to gross negligence fraud or intentional misconduct by CaskBlock. If dissatisfied your only recourse is to stop using our services. This remedy is independent of other liability limitations in this agreement.13 - Indemnity
You agree to protect compensate and exempt CaskBlock its affiliates employees officers suppliers distributors directors contractors representatives agents and partners (including alcohol brand owners) (collectively "CaskBlock Parties") from any legal claims damages losses expenses investigations liabilities judgments fines penalties settlements interest and costs (including attorneys' fees). This applies to claims and losses that directly or indirectly result from or relate to: You provided feedback. Your misuse of our Services or CaskBlock NFTs. Your breach or alleged breach of these Terms or your stated representations and warranties. Your actual or alleged violation of any laws rules regulations codes statutes ordinances or governmental or regulatory orders related to your use of our Services or NFTs. Any information or material transmitted through your device that infringes violates or misappropriates intellectual property rights. Any misrepresentation made by you. You must fully cooperate with CaskBlock Parties in defending against any claims and losses. CaskBlock Parties maintain the exclusive right to settle compromise and pay any such claims and losses. They also reserve the right to assume exclusive defense and control of any claims and losses. You may not settle any claims and losses without prior written consent from a CaskBlock Party officer.14 - Errors on our site or related to CaskBlock NFTs

Disclaimer of Responsibility:We are not liable for inaccuracies in listed prices or availability status on our website. This includes errors made by users when listing CaskBlock NFTs on the secondary market.
Price Adjustment Rights:We reserve the right to adjust prices before the sale if the initial listing contains an error. We will not arbitrarily alter prices set by NFT owners.

Carrier Fees:Standard messaging data and other carrier fees may apply for mobile activities. Users are advised to contact their carriers directly regarding these charges. CaskBlock is not responsible for carrier fees.

15 - Choice of Law; Arbitration; and Class Action Waiver
Governing Law:The Portuguese Law without regard to any other applicable choice-of-law principles shall govern any action related to these Terms of Service the use of the Platform or the Services.Arbitration Agreement:In the event of a dispute between you and us arising under or relating to the Platform or the Services you acknowledge and agree that by using the Platform or the Services you irrevocably commit to resolving any such dispute or claim through binding arbitration. This means that neither party has the right to litigate the dispute or claim in court or to have a jury trial. You agree to mandatory individual arbitration for dispute resolution waiving your right to a jury trial on your claims. Note that discovery and appeal rights are limited in arbitration.
Arbitration Process:Any dispute related to these Terms including questions regarding their existence validity or termination shall be referred to and finally resolved by arbitration under the rules of the Portuguese Law in effect at the time of arbitration except as modified herein. The arbitration shall be conducted by a single arbitrator selected by CaskBlock. The legal place of arbitration shall be Lisbon Portugal and the proceedings shall be in Portuguese. The governing law for these Terms is the substantive Portuguese Law applicable to contracts made executed and wholly performed within Portugal. A printed version of these Terms and any notice given in electronic form shall be admissible in arbitral proceedings subject to the same conditions as other business documents maintained in printed form.
Finality and Enforcement:The arbitration award shall be final and binding on the parties. Both parties undertake to carry out any award promptly and waive their right to any form of recourse to the extent valid. Judgment upon the award may be entered by any court with jurisdiction over the relevant party or its assets. Each party shall be responsible for its respective attorneys’ fees and expenses.
Statute of Limitations:Regardless of any contrary statute or law any claim or cause of action arising from using the Services or these Terms must be filed within one (1) year after such claim or cause of action arose or it will be forever barred.
16 - Class Action Waiver
Arbitration must occur on an individual basis. This means that neither you nor CaskBlock may join or consolidate claims in arbitration against other individuals nor litigate in court or arbitrate any claims as a representative or member of a class or in a private attorney general capacity. Unless you opt out of the arbitration agreement you will only be permitted to pursue claims and seek relief against us individually not as a plaintiff or class member in any class or representative action or proceeding.17 - Termination of Use
We reserve the right to terminate your CaskBlock.com account with or without cause at any time effective immediately. You remain personally liable for any orders placed or charges incurred before termination. Additionally we retain the right to change suspend or discontinue any aspects of the site without prior notice.18 - General Provisions
We along with our agents representatives contractors and suppliers may make improvements and changes to the Platform Services and Content on the site. All features and functions may change at any time without liability. You are responsible for compliance with applicable laws and regulations recognizing that access to our site may be illegal for certain individuals or in specific countries. Our failure to exercise a right or enforce a provision at any particular time does not constitute a waiver of that or any other right. Registration is necessary for the user to complete the purchasing of a product or subscription through the available subscription plans subscribe to newsletters make comments and access other online features provided by CaskBlock.
CaskBlock collects technical information about the user’s equipment whenever they visit our digital platforms including browser IP address operating system internet search engine used screen resolution and favorite websites. This information is essential to guarantee the registration process and provide a service tailored to users.

At any time you can stop receiving these messages by canceling the digital newsletters or sending an email to us.

26 - Retention Time of Personal Data
CaskBlock treats and preserves your data according to the purposes for which they are collected and processed and only for the period necessary to fulfill those purposes. According to the law CaskBlock may need to keep the data for a minimum period:1 year for traffic and location data to investigate detect and prosecute serious crimes.
10 years for information to the Tax Authority for accounting or tax purposes.

29 - Transmission of Personal Data
Personal data may be transmitted to subcontractors for processing on behalf of CaskBlock. In such cases CaskBlock takes necessary contractual measures to ensure that subcontractors respect and protect the personal data of data subjects.
